Terms of Service

These Terms of Service (“Terms”) govern your use of the SyncHer mobile app and website (“SyncHer”), provided by Rise, Tokiostraße 12, 1220 Vienna, Austria (“we”, “us”). By downloading or using SyncHer you agree to these Terms. If you don't agree, please don't use SyncHer.

1. What SyncHer is — and isn't

SyncHer helps you anticipate and respond thoughtfully to your partner's menstrual cycle. It estimates cycle phases from dates you enter and offers general suggestions.

Suggestions, including AI-generated tips and Chat replies, are general ideas. They may be inaccurate or unsuitable for your situation. Use your own judgment, and always respect what your partner tells you.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use SyncHer.

3. Using SyncHer responsibly

You agree not to:

• use SyncHer to monitor, control, harass or harm anyone;
• enter information you have no right to use;
• include names or identifying details of other people in text you send to AI tips;
• misuse, reverse engineer, overload or interfere with SyncHer or its servers, or bypass usage limits;
• use SyncHer for any unlawful purpose.

We encourage being open with your partner about using SyncHer.

4. Subscriptions, free trials and payment

Some features require a paid auto-renewing subscription, offered monthly or yearly. Prices are shown in the app before purchase and may vary by country.

• Billing. Payment is charged to your Apple ID (or Google account, once available) at confirmation of purchase, or when a free trial ends.
• Auto-renewal. Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Free trial. Eligible new subscribers may get a 3-day free trial. Eligibility is determined by the app store. Unless cancelled at least 24 hours before the trial ends, it converts into a paid subscription.
• Cancelling. Manage or cancel in your App Store account settings. Cancelling stops future renewals; you keep access until the end of the paid period. Deleting the app does not cancel a subscription.
• Refunds. Purchases are processed by the app store, and refund requests are handled under its policies (for Apple: reportaproblem.apple.com). This doesn't limit any statutory rights you have.
• Price changes. If we change subscription prices, the app store will notify you as required and, where required, ask for your consent.

If you are a consumer in the EU or UK, you have a statutory 14-day right of withdrawal for digital purchases. By starting to use the subscription immediately, you acknowledge that this right may end once the service has been fully provided, as permitted by law. Withdrawal requests for store purchases are handled through the app store.

5. AI tips

AI tips are optional and only used if you agree during setup or turn them on in Settings. While on, limited information is sent to our service providers to generate tips, as described in our Privacy Policy. We may limit the number of AI requests per day and may change, suspend or discontinue AI features. When AI tips are unavailable, SyncHer uses built-in tips.

6. Your data

The information you enter is stored on your phone and you're responsible for it, including keeping your phone secure. We can't recover data that is deleted or lost with your phone. Our Privacy Policy explains how we handle personal data.

7. Intellectual property

SyncHer, including its design, the Wingman character, text and software, belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, in line with these Terms and the app store's usage rules. The Apple Licensed Application End User License Agreement also applies to downloads from the App Store.

8. Availability and changes

We work to keep SyncHer running but don't guarantee it will always be available or error-free. We may update, change or discontinue features. If we discontinue a paid feature, we'll handle it fairly and in line with applicable law and app store rules.

9. Disclaimers

To the extent permitted by law, SyncHer is provided “as is” and “as available”, without warranties of any kind, including accuracy of forecasts or suitability of suggestions. Nothing in these Terms excludes rights you have as a consumer that cannot be excluded by law.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, or for decisions you make based on SyncHer's forecasts or suggestions. Our total liability for any claim relating to SyncHer is limited to the amount you paid for SyncHer in the 12 months before the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.

11. Ending use

You can stop using SyncHer at any time by deleting the app and cancelling any subscription. We may suspend access if you seriously or repeatedly break these Terms.

12. Apple App Store terms

If you downloaded SyncHer from the App Store: these Terms are between you and us, not Apple. Apple is not responsible for SyncHer or its content, has no obligation to provide maintenance or support, and is not responsible for any product claims, including claims that SyncHer fails to meet legal or regulatory requirements. If SyncHer fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for investigating or defending third-party intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

13. Changes to these Terms

We may update these Terms. We'll change the effective date above and, for material changes, let you know in the app. Continuing to use SyncHer after changes take effect means you accept them.

14. Governing law

These Terms are governed by the laws of Austria. If you are a consumer, you also keep the protection of mandatory laws of the country where you live, and you may bring claims in your local courts. EU consumers can also use the EU's online dispute resolution information at consumer-redress.ec.europa.eu.
